PRICING, TERMS AND SPECIFICATIONS
Prices and specifications shown are current at the time of printing. We make every effort to hold these prices and specifications until the printing of our next catalog; however, prices and specifications are subject to change without notice. All prices are in US dollars. LKT ships orders F.O.B. St. Paul, MN, USA. Payment terms are Net 30 Days from the date of invoice. LKT accepts Visa, MasterCard and Discover. Sales, use, excise and other applicable taxes will be charged.

SHIPPING INFORMATION
Products from stock will be shipped within 24 hours by the most efficient method available (generally 2nd day air, unless otherwise requested) upon receipt of the purchase order. Freight charges are prepaid and added to the invoice. We request that all international orders be prepaid. They will be shipped using the customers own courier account (FedEx, DHL, or UPS) for express delivery. If no account number is available, USPS express mail service (EMS) will be used.

SAFE HANDLING
Certain items may require special handling, packaging or shipping (e.g. hazardous materials, dry ice shipping, etc.). In such cases extra charges must be levied to cover the costs of the specialized requirements. Items that require cold long-term storage may not necessarily be shipped in ice. Please include the name, telephone number or fax number of the person who will be knowledgeable in handling special shipments to avoid delay in custom clearance or proper storage of the materials.

USE OF PRODUCTS
LKT’s products are intended primarily for laboratory research purposes and are not to be used for any other purposes.

Buyer acknowledges that the products have not been tested by LKT for safety and efficacy. Buyer expressly represents and warrants to LKT that Buyer will properly test, use manufacture and market any products purchased from LKT and/or materials produced with products purchased from LKT in accordance with the practices of a reasonable person who is an expert in the field and in strict compliance with all applicable laws and regulations, now and herein after enacted.

Buyer has responsibility to verify the hazards and to conduct any further research necessary to learn the hazards involved inusing products purchased from LKT. Buyer also has the duty to warn Buyer’s customers and any auxiliary personnel (such as freight handlers, etc.) of any risks involved in using or handling the products. Buyer agrees to comply with instructions, if any furnished by LKT relating to the use of the products and not misuse the products in any manner. If the products purchased from LKT are to be repackaged, relabeled or used as starting material or components of other products, Buyer will verify LKT’s assay of the products. No products purchased from LKT shall be considered to be foods, drugs, medical devices or cosmetics.

WARRANTIES AND DISCLAIMERS
LKT warrants that its products shall conform to the description of such products as provided by LKT through LKT’s catalog, analytical data or other literature.

This warranty is exclusive, and LKT makes no other warranty, express or implied, including any implied warranty of merchantability or fitness for any particular purpose.

LKT’s sole and exclusive liability and Buyer’s exclusive remedy with respect to products proved to LKT’s satisfaction to be defective or nonconforming shall be replacement of such products without charge or refund of the purchase price, at LKT's sole discretion, upon the return of such products in accordance with LKT’s instructions. LKT shall not in any event be liable for incidental, consequential or special damages of any kind resulting from any use or failure of the products. This limitation expressly includes but is not limited to, damages to a third party occasioned by such product. All claims must be brought within 60 days after receipt of the material by the Buyer, regardless of their nature.

RETURN POLICY
Contact our Customer Service Department for a Return Authorization within 30 days for replacement of any product sold by LKT Labs that does not meet the standards indicated by the product specification.
